The Supreme Court of Canada has dismissed the application to appeal by Economical Insurance in the case of Tomec v. Economical Mutual Insurance Company, 2019 ONCA 882. In doing so, it has upheld the Ontario Court of Appeal’s ruling that applies a standard of discoverability, rather than a hard timeline, on applications for catastrophic injury benefits emerging out of auto injuries.
